Big Signal is operated by Tyrus Robert Ian Ridley, ABN 32 961 964 695, trading as Big Signal ("Big Signal", "we", "our" or "us").
By using our website, creating an account, requesting a quote, making a booking or purchasing a service from us, you agree to these Terms and Conditions.

2. Customer Accounts
Big Signal may require customers to create and sign into an account before making or managing a booking.
You are responsible for:
-
providing accurate and current information;
-
maintaining the confidentiality of your login details;
-
activity carried out through your account; and
-
notifying us if you believe your account has been accessed without permission.
You must not create an account using false information or impersonate another person or organisation.
We may suspend or restrict an account where we reasonably believe it is being misused, compromised or used in breach of these Terms.
3. Quotes and Bookings
Submitting a booking request does not automatically mean that the booking has been accepted.
A booking becomes confirmed once Big Signal accepts the booking and provides confirmation and any required payment or deposit has been received.
Quotes are valid for the period stated on the quote.
Unless otherwise stated, quoted pricing applies only to the:
-
service;
-
date;
-
location;
-
route;
-
duration; and
-
other requirements
specified in the quote or booking.
Changes may result in additional charges.
4. Pricing and Payment
All prices are in Australian dollars unless otherwise stated.
GST will only be charged where Big Signal is registered or otherwise legally required to charge GST. Where GST applies, it will be clearly identified on the relevant invoice, quote or checkout.
Payments may be processed using third-party payment providers including Stripe.
You agree to pay all amounts due by the date specified at checkout, on your invoice or in your booking confirmation.
Where a deposit or booking payment is required, a date or booking may not be secured until the required payment has been received.
Big Signal may refuse to commence or continue a service where an amount is overdue.
Additional work or services requested outside the confirmed scope may be charged separately.
5. Advertising Content
Customers are responsible for supplying advertising material in the format, quality and timeframe requested by Big Signal.
Advertising material may include:
-
images;
-
graphics;
-
videos;
-
animations;
-
logos;
-
text;
-
audio;
-
campaign instructions; and
-
other promotional material.
Where content is supplied late, incorrectly formatted, corrupted or otherwise unusable, Big Signal will make reasonable efforts to resolve the issue but cannot guarantee the original campaign schedule.
A delay caused by customer-supplied content does not automatically entitle the customer to a refund.
6. Rights to Customer Content
Customers retain ownership of advertising material supplied to Big Signal.
By providing material to us, you grant Big Signal a limited licence to:
-
store;
-
reproduce;
-
resize;
-
crop;
-
convert;
-
format;
-
transmit; and
-
display
the content where reasonably necessary to deliver the booked service.
You confirm that you have all rights, licences and permissions necessary for Big Signal to display the material.
You must not provide content that:
-
infringes copyright, trade marks or other intellectual property rights;
-
is defamatory;
-
is unlawful;
-
is misleading or deceptive;
-
promotes illegal goods, services or activities;
-
contains malicious software or harmful code; or
-
would cause Big Signal to breach applicable laws or regulatory requirements.
Big Signal may refuse or stop displaying material where we reasonably believe it is unlawful, unsafe, infringing, seriously offensive or otherwise inappropriate for the service.
7. Content While the Vehicle Is Moving
For safety and compliance reasons, advertising displayed while a Big Signal vehicle is moving may be limited to static advertising content.
Video, animation, rapidly changing imagery, audio and similar material may only be used while the vehicle is stationary where appropriate.
Big Signal retains final operational control over content displayed on its vehicles where necessary for safety or legal compliance.
8. Mobile Advertising Routes
Where a booking includes a mobile advertising route, proposed routes are indicative unless expressly guaranteed in writing.
Routes may need to change because of:
-
traffic;
-
congestion;
-
crashes;
-
road closures;
-
roadworks;
-
vehicle restrictions;
-
police or emergency activity;
-
weather;
-
safety conditions;
-
major events;
-
legal restrictions; or
-
other circumstances reasonably outside Big Signal's control.
Big Signal will make reasonable efforts to deliver the intended campaign and coverage.
Unless specifically agreed in writing, Big Signal does not guarantee:
-
a particular number of advertising impressions;
-
a specific audience size;
-
leads;
-
enquiries;
-
sales;
-
conversions;
-
business results;
-
exact arrival times at every location; or
-
continuous visibility to a particular audience.
9. Onsite and Event Hire
Where Big Signal attends an event, venue, private property or customer-controlled location, the customer is responsible for ensuring that:
-
Big Signal has permission to enter and operate at the site;
-
suitable vehicle access is available;
-
sufficient operating space is available;
-
the site and access areas are reasonably safe;
-
customer-controlled approvals have been obtained; and
-
the location information provided to Big Signal is accurate.
Big Signal may refuse to position or operate equipment where we reasonably consider the area unsafe, inaccessible, unsuitable or unlawful.
Additional charges may apply where unexpected access issues, waiting periods, relocation or customer-requested changes create additional costs.
10. Raised Screen and Equipment Setup
Certain Big Signal vehicles or displays may include screens or other equipment capable of being raised or repositioned.
Raised-screen operation will only occur where Big Signal considers the location, weather, surroundings, overhead clearance, ground conditions and other relevant factors suitable.
Big Signal has final authority over whether equipment can safely be raised, positioned or operated.
11. Audio
Audio or sound services may be available for suitable stationary bookings.
Big Signal may limit or refuse audio use where necessary because of:
-
venue requirements;
-
noise restrictions;
-
local laws;
-
safety considerations; or
-
surrounding properties and businesses.
12. Permits and Approvals
Responsibility for permits and approvals depends on the nature and location of the booking.
Big Signal is responsible for permits or approvals that we expressly agree in writing to obtain.
The customer remains responsible for permissions relating to property, venues, event organisers or other locations under their control unless otherwise agreed.
Neither party should assume the other has obtained an approval unless it has been confirmed.
13. Customer Cancellations
Unless different cancellation conditions are stated in your booking confirmation or quote:
More than 7 days before the booking
Amounts paid may be refunded, less reasonable non-refundable third-party costs and work already completed.
Between 48 hours and 7 days before the booking
Up to 50% of the booking value may be retained or charged.
Less than 48 hours before the booking
Up to 100% of the booking value may be retained or charged.
Where reasonably possible, Big Signal may allow a booking to be moved to another available date rather than cancelled.
Cancellation fees will be applied reasonably having regard to:
-
costs already incurred;
-
work already performed;
-
capacity reserved for the customer;
-
third-party costs; and
-
our ability to accept another booking for that period.
Nothing in this section limits rights that cannot lawfully be excluded under the Australian Consumer Law.
14. Changes and Rescheduling
Requests to change campaign dates, times, locations, routes, advertising material, operating duration or other requirements are subject to availability.
Additional charges may apply where a change requires additional:
-
travel;
-
labour;
-
preparation;
-
design;
-
permits;
-
setup; or
-
operating time.
A change is not confirmed until accepted by Big Signal.
15. Weather
Big Signal's vehicles and equipment operate outdoors and can be affected by weather.
Big Signal may delay, modify, suspend or reschedule a service where weather conditions create an unreasonable safety risk or prevent the service from being delivered as intended.
Where reasonably practical, we will work with the customer to arrange an alternative time, date or other solution.
16. Vehicle or Equipment Failure
Big Signal takes reasonable steps to maintain its vehicles, displays, electrical systems and other equipment.
If a significant mechanical or technical failure prevents us from supplying a booked service, Big Signal may, depending on the circumstances:
-
repair or rectify the issue;
-
provide alternative equipment;
-
extend part of the campaign;
-
repeat the affected portion;
-
reschedule the booking; or
-
provide an appropriate refund or credit.
Any remedy remains subject to rights available under the Australian Consumer Law.
17. Circumstances Outside Our Control
Neither party will be liable for failure to perform an obligation to the extent that performance is prevented by circumstances reasonably outside that party's control.
Examples may include:
-
serious weather events;
-
natural disasters;
-
major road closures;
-
emergencies;
-
government restrictions;
-
infrastructure failures;
-
widespread utility failures; or
-
other events that could not reasonably have been prevented.
This section does not exclude rights or obligations that cannot legally be excluded.
18. Australian Consumer Law
Our services come with rights and guarantees that cannot be excluded under the Australian Consumer Law where that law applies.
Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
Where liability can legally be limited, it will be limited only to the extent permitted by law.
19. Customer Responsibility and Indemnity
To the extent permitted by law, customers are responsible for loss, claims or costs arising from advertising material they supply where that material:
-
infringes another person's intellectual property;
-
is defamatory;
-
is unlawful;
-
is misleading or deceptive; or
-
has been supplied without required permission.
This does not make a customer responsible for loss caused by Big Signal's negligence, unlawful conduct or breach of obligations that cannot legally be excluded.
20. Big Signal Intellectual Property
Big Signal owns or licenses the intellectual property used in:
-
the Big Signal website;
-
Big Signal branding;
-
logos;
-
original graphics;
-
photographs;
-
videos;
-
advertising material; and
-
other original content created by Big Signal,
unless otherwise stated.
You may not copy, reproduce, commercially exploit or represent Big Signal material as your own without permission.
Ownership of custom creative work produced specifically for a customer will be governed by the applicable quote or agreement.
21. Photography and Portfolio Use
Big Signal may photograph or film its own vehicles, LED displays and equipment during operations.
Where a customer's advertising is clearly identifiable, Big Signal may seek permission before using that campaign as a featured case study, testimonial or dedicated promotional campaign.
Nothing in these Terms transfers ownership of a customer's brand or advertising material to Big Signal.
22. Website Availability
We aim to keep the Big Signal website and online systems available but cannot guarantee uninterrupted access.
The website may occasionally be unavailable because of maintenance, updates, third-party outages or technical problems.
23. Third-Party Services
Big Signal may use third-party providers including:
-
Wix;
-
Stripe;
-
email providers;
-
analytics providers;
-
mapping and navigation systems; and
-
other technology providers.
Third-party services may be subject to their own terms and privacy policies.
Big Signal is not responsible for independent third-party services except where required by law.
24. Privacy
Personal information is handled in accordance with the Big Signal Privacy Policy.
25. Disputes
If a dispute arises, both parties should first make reasonable efforts to resolve the issue directly and in good faith.
Customers can contact Big Signal using the details below.
Nothing in this section prevents either party from exercising any rights available under applicable law.
26. Changes to These Terms
Big Signal may update these Terms from time to time.
The Terms applying to a confirmed booking will generally be those in effect when the booking was made unless:
-
otherwise agreed between the parties; or
-
a change is required by law.
The latest version will be available on the Big Signal website.
27. Governing Law
These Terms are governed by the laws of Queensland, Australia.
The parties submit to the courts and tribunals having jurisdiction in Queensland, subject to any rights available under applicable consumer law.
